User (1) is entitled to use the Software by purchasing the Software Package. The software package contains all purchased modules and other parts of the software. The user is permitted to transfer the software to another user only as a complete package, it cannot be further divided. Only one service agreement may be concluded for the software package. Other persons, such as affiliates or subsidiaries may also use the software package if stipulated in the service agreement.
The software package contains exactly one software installation. Under the service agreement, the number of installations may be increased provided that the total number for each module does not exceed the number of module licenses in the software package.
Each installation authorizes the user to locate one copy (master copy) of the software on the server and creation of one production database of the (3) software, unless otherwise specified in the service agreement. The number of test databases (4) is not limited. If required for technical reasons, the user is entitled to make multiple copies of the software package system on other workstations or servers with the consent of the supplier. These sub-copies can only be used to access the same database as the master copy, for example for remote access, network load, optimization, etc.
The user is not entitled to make additional copies of the Software without the written consent of the Supplier. Such conduct constitutes a breach of the Purchase Agreement and the Supplier is fully entitled to withdraw authorization to use the Software without any compensation. This however does not affect the right to claim damages caused by the user.
Module software is supplied in the form of floating licenses. The user is entitled to use at any time maximally the number (simultaneous launches) of module instances as purchaed in the license. In the case of closing a service agreement, the user is entitled to use as many instances as the licenses specified in the service agreement.
Drivers and interface software are supplied in the form of instalalation licenses. The user is entitled to use each purchased driver or interface license as part of just one installation, withoutlimitingthe number of starts.
Customized reports and print reports can be used without restriction in all software package installations. Usage must comply with the license terms of the module for which they were created.
1) The user is a direct or legal figure authorized to use the Palstat CAQ system set in the purchase or the service agreement. For this purpose, the Purchase Agreement means both a written Purchase Agreement and a Purchase Agreement in the form of an accepted order and a paid invoice.
2) The software is a Palstat CAQ system and this includes all components to the extent defined in the purchase or service agreement.
3) A production database is a database that used by the user for day-to-day use of the software, for entering data of real-world operations, creation of outputs to be used both internally and for business partners.
4) The test database is a database that is only used by the user to test software behaviour when working with test data, traiing softwrae operators or similar activities.
